What is a full and final settlement in the UAE?

A full and final settlement is the total amount owed to an employee when their employment ends. It includes end-of-service gratuity, unused annual leave encashment, notice period compensation (if applicable), pending salary, and any unpaid overtime or allowances.

When must the employer pay the settlement?

Under UAE labour law, the employer must pay all dues (settlement) within 14 days of the employee's last working day. Failure to do so is a violation, and the employee can file a complaint with MOHRE.

What components are included in the settlement?

The settlement typically includes: (1) End-of-service gratuity, (2) Unused annual leave encashment, (3) Notice period compensation (if not fully served), (4) Pending salary for days worked, (5) Unpaid overtime, and (6) Any other contractual benefits.

Do I lose my gratuity if I resign?

No. Under Federal Decree-Law No. 33 of 2021, employees who resign are entitled to their full gratuity (if they have completed 1+ year of service). The old resignation reduction rules were abolished.

What happens to my settlement if terminated for misconduct?

Under Article 44, if you are terminated for gross misconduct, you forfeit your end-of-service gratuity. However, you are still entitled to unused leave encashment, pending salary, and other accrued benefits.

Can I negotiate my settlement amount?

The settlement amounts for gratuity and leave encashment are fixed by law and cannot be negotiated downward. However, you can negotiate additional separation payments, extended notice periods, or other benefits beyond the legal minimum.

What if my employer doesn't pay my settlement?

If your employer fails to pay within 14 days, file a complaint with MOHRE (mohre.gov.ae or call 600-590000). MOHRE will attempt to mediate. If unresolved, the case can be referred to the Labour Court.

Is the settlement amount taxable?

No. The UAE has no personal income tax. Your entire settlement — gratuity, leave encashment, notice compensation, and pending salary — is received tax-free.

Does the settlement include end-of-service certificate?

Your employer is legally required to provide an end-of-service certificate upon request. This is separate from the financial settlement and should include your job title, duration of service, and last salary. They cannot charge for this certificate.

How is leave encashment calculated in the settlement?

Leave encashment is calculated as: (Basic Salary ÷ 30) × Number of Unused Leave Days. Only your basic salary is used, and all accrued unused annual leave must be paid out upon termination.
