What is the minimum notice period in the UAE?
Under Federal Decree-Law No. 33 of 2021, the minimum notice period is 30 days for confirmed (post-probation) employees. During probation (Article 9), both employees and employers must give at least 14 days' written notice. Your employment contract may specify a longer notice period.
What is the maximum notice period allowed?
The maximum notice period is 90 days (3 months). This applies to both employer termination and employee resignation. The exact period depends on what is stated in your employment contract, but it cannot exceed 90 days.
What happens if I don't serve my notice period?
If you fail to serve the full notice period, you must pay your employer compensation equal to your salary for the notice period (or the remaining unserved portion). Similarly, if your employer terminates you without proper notice, they must pay you the equivalent compensation.
Can the notice period be waived?
Yes. The notice period can be waived by mutual written agreement between the employer and employee. Both parties must agree — one party cannot unilaterally waive the notice period.
Am I entitled to my full salary during the notice period?
Yes. During the notice period, you are entitled to your full salary and all benefits as per your employment contract. Your employer cannot reduce your salary or benefits during this time.
What is the notice period during probation?
Under Article 9, both employees and employers must give at least 14 days' written notice during the probation period. The employment contract may specify a longer period. The probation period cannot exceed 6 months.
Does the notice period include weekends and holidays?
Yes. The notice period is counted in calendar days, not working days. Weekends and public holidays are included in the count.
Can I use my annual leave during the notice period?
You can use annual leave during the notice period if your employer agrees. However, any unused leave will be paid out as encashment upon termination. The employer can also require you to take leave during the notice period.
