Switching jobs in the UAE is far simpler than it was a decade ago. The old no-objection-certificate culture and automatic labour bans are largely gone under the 2022 labour law, and moving employer is now a standard, regulated process.
What still trips people up is the notice period: how long it really is, whether it can be bought out, and what must land in your bank account before you walk out the door. Here are the rules.
The 30 to 90 day rule
After probation, notice must be between 30 and 90 days, whatever your contract says. A clause demanding six months' notice is unenforceable; a clause allowing zero notice is equally invalid.
- The notice period is the same for both sides. Your employer must give you the identical notice it demands from you.
- Notice must be in writing, and you work and are paid normally throughout it.
- Payment in lieu is legal. Either side can end the arrangement early by paying the salary for the remaining notice days, if both agree or the contract allows it.
- If your employer served the notice, you are entitled to one unpaid day off per week to look for a new job, provided you tell them a few days ahead.

Resigning properly: the sequence
- Secure the written offer first. Never resign on a verbal promise. UAE offers can move slowly through approvals, and your notice clock should only start once the new contract terms are in writing.
- Check your notice length and any non-compete clause in your MOHRE contract before you hand anything in. Non-competes are enforceable only if they are limited in time (a maximum of two years), geography and scope, and courts read them narrowly.
- Resign in writing, dated, stating your final working day. Keep a copy and proof of delivery.
- Serve the notice professionally. Handover documents, finish open work, stay visible. UAE industries are small and your reputation transfers with you.
- Agree the exit logistics: final settlement date, experience letter, and cancellation timing that lines up with your new employer's permit application.
Your final settlement
Within 14 days of your last working day, your employer must pay everything owed:
- Salary up to the final day, plus any unpaid overtime or commissions.
- Payment for unused annual leave days, calculated on basic salary.
- End of service gratuity: 21 days of basic salary per year for your first five years of service, 30 days per year after that. Run your own number with the gratuity calculation guide before your exit meeting, because settlement errors are common and easier to fix before you sign a receipt.
- Any contractual extras such as a pro-rated bonus or repatriation ticket if you are leaving the country.
If the settlement is short or late, you can file a complaint with MOHRE, and resigning does not weaken that claim.
The visa side of switching
Moving employer means cancelling one sponsorship and starting another, and the sequence matters:
- Your new employer applies for your work permit approval, your old employer cancels your existing permit and residence visa, then the new employment visa process runs: entry status change, medical, Emirates ID update, stamping.
- After cancellation you get a grace period, typically 30 to 180 days depending on your visa type, so a short gap between jobs does not make you illegal. Confirm your own window on the ICP or GDRFA portal.
- Time the two so your family's sponsorship, school registrations and bank standing orders survive the transition.
Most switches complete within two to four weeks once the paperwork starts, and your new employer's PRO does the heavy lifting.

Can my employer refuse my resignation?
No. Resignation is your right and does not need approval. The employer can require you to serve the contractual notice, but cannot reject the resignation itself or hold your visa hostage.

Will I get a labour ban for switching jobs?
