Frequently Asked Questions

How long is the probation period in the UAE?

The maximum probation period is 6 months (180 days) under Article 9 of Federal Decree-Law No. 33 of 2021. Your employer can set a shorter probation period (e.g. 3 or 4 months), but cannot exceed 6 months. Probation cannot be extended or renewed.

Can I resign during probation in the UAE?

Yes. You can resign during probation by giving at least 14 days' written notice. If you are moving to a new UAE employer, the notice period is 30 days. If you leave the UAE during probation without the employer's agreement, you may be subject to a 1-year work permit ban.

Can my employer terminate me during probation?

Yes. Your employer can terminate your employment during probation by giving 14 days' written notice. They do not need to provide a reason during the probation period. You are entitled to your salary and benefits for the notice period.

Do I get annual leave during probation?

Leave accrues from day 1 of employment, but most employers do not allow you to take annual leave during the probation period. Any accrued unused leave will be paid out if your employment ends during probation.

Am I entitled to sick leave during probation?

No. Under Article 31(5) of the labour law, employees are not entitled to paid sick leave during probation. Your employer may grant unpaid sick leave at their discretion, and they cannot terminate you solely for being sick (Article 31(6)).

Do I get gratuity (end-of-service) if I leave during probation?

No. End-of-service gratuity requires at least 1 year of continuous service. If your employment ends during probation, you will not receive any gratuity payment.

What happens after probation ends?

Once probation is complete, you become a confirmed employee with full rights including: paid sick leave, the standard notice period (30–90 days as per your contract), and your service counts toward gratuity calculation from day 1.

Can probation be extended beyond 6 months?

No. The law is clear that probation cannot exceed 6 months. If your employer tries to extend it, this is a violation of UAE labour law. Once the probation period ends, you are automatically considered a confirmed employee.

What notice period applies if I move to a new UAE employer during probation?

If you resign during probation to join a new UAE employer, you must give 30 days' written notice (Article 9(4)). The new employer may be required to compensate your current employer for recruitment costs. This is more restrictive than the standard 14-day notice.

Does my employer need to provide medical insurance during probation?

Yes. Medical insurance is mandatory for all employees from the start of employment, including during probation. This is required by law in all emirates, with specific requirements varying by emirate (e.g. DHA in Dubai, HAAD in Abu Dhabi).
